Terms of Use

These terms and conditions set out the basis on which you can visit our website, order and buy goods through our online delivery service, and where applicable, take part in any of our membership or promotional event(s).

Please read through these terms and conditions carefully before using this website, and also read our Privacy Policy regarding your personal information.

We aim to process all enquiries and requests as quickly as possible, but we reserve the right to restrict, refuse or cancel orders, as well as refuse access to the website and terminate accounts at our discretion. This website is intended for use by adult consumers residing in Singapore only and for delivery within Singapore.

We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.

Online Orders

1. Pricing

1.1. Clarks has taken every care in the preparation of the content of this website, in particular we try to ensure that all the prices shown on the website are accurate. In the event of any typographical pricing errors, omissions, or inconsistencies, Clarks reserves the right to refuse or cancel any orders placed for products incorrectly priced, regardless of whether your credit card has been charged or a confirmation was sent. In the event that your credit card was charged for the incorrect amount and your order is cancelled, Clarks will reimburse your credit card for the full amount you were charged.

1.2. Pricing and availability information is subject to change without notice. 

1.3. All prices are quoted in Singapore Dollars (S$). All prices are inclusive of sales tax where appropriate but do not include delivery charges.

1.4. Prices of goods displayed in and ordered through this website may differ from prices in store. 

2. How your order is processed

2.1. After you have placed an order with us, we will send an email acknowledgment of that order to your designated email address. This email is a confirmation and receipt of your order.

    2.2. If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary.

      3. Availability

        3.1. Our receipt of your offer to purchase our goods is subject to their availability. Our acknowledgment of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that any despatch times given/provided are just estimates and shall not be taken to be a guarantee or be relied upon as such. 

          4. Payment 

            4.1. Payment can be made using the following major credit and debit cards: Visa, Mastercard, Maestro, and Electron. Payments can also be made via PayPal.

              5. Governing law and jurisdiction

                5.1. These terms and conditions, together with our current website prices, delivery details, contact details and Privacy Policy, set out the whole of our agreement relating to the supply of any goods or services to you by us, and shall be governed by and interpreted in accordance with the laws of Singapore. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.
                  5.2. If any dispute arises regarding any of our products or services or any aspect of these terms and conditions which cannot be resolved in good faith and amicably between you and us, you agree that any and all such dispute shall first be submitted for mediation at the Singapore Mediation Centre (“SMC”) in accordance with SMC’s Mediation Procedure in force for the time being. You may submit a request to mediate to SMC upon which we will be bound to participate in the mediation within 45 days thereof. Unless otherwise agreed by you and us, the Mediator(s) will be appointed by SMC. The mediation will take place in Singapore in the English language and you and us agree to be bound by any settlement agreement reached.

                    5.3. If the dispute cannot be resolved via mediation at the SMC as detailed above, the courts of Singapore shall have exclusive jurisdiction to hear the dispute.

                      6. Delivery

                        6.1. All deliveries are subject to stock availability and authorisation of your payment.
                          6.2. We can deliver your order to an address of your choice. The delivery address must be in Singapore. Clarks reserves the right not to deliver to areas that are remote or that require security Pass/ Clearance, Safety briefing or donning of safety gears. If we do, an additional surcharge of S$15 will be imposed for delivery. A few examples are:

                            "Alps Avenue, Changi Cargo Complex/Ferry Terminal, Airport link, Jurong Island, Lim Chu Kang, MID Bases, Sentosa, Senoko, Sembawang Park, Tanah Merah Ferry Terminal, Tuas View Extension, Changi Airports"

                            For home delivery, the delivery charge is the same, irrespective of the number of items ordered. The maximum order you will be able to make is sixteen items/pairs of shoes, of which no more than two sizes can be of the same style. 

                            7. Standard Delivery

                              7.1. There is a standard home delivery charge of $3.50 under $99 order. Any order above $99 will be complimentary shipping across Singapore.

                                8. Returns

                                  8.1. We make every effort to ensure that your order is carefully despatched to you, and we hope that you're happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them.

                                    8.2. Items must be in their original condition, unworn and returned within 28 days of receiving them. You may get in touch with us using our online contact form to initiate a return.

                                      9. How Clarks can cancel this agreement

                                        9.1. We reserve the right to cancel the order if:-
                                        • We have insufficient stock to fulfil your order.
                                        • We are unable to obtain payment.
                                        • We do not deliver to your area.
                                        • A product fault or an error in the product description has been identified.

                                          Use of Clarks Website

                                          10. Ownership of rights

                                            10.1. All rights, including copyright, in the text, graphics and layout of this website and in all software and software compilations are owned by, or licensed to, Clarks.

                                              10.2. You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt this website, its contents or underlying software, except for personal non-commercial use.

                                                11. Accuracy of content

                                                  11.1. We have made every effort to ensure that the products are fairly described, that the product information is correct, and that the colours of our products are displayed as accurately as possible. However, as the actual colours you see will vary with the quality of your monitor, we cannot guarantee that your display will accurately reflect the colour of the product requested on delivery.
                                                    11.2. If, on receiving ordered goods, you have any cause for dissatisfaction you may return them via our “Returns” procedure, which is explained above.

                                                      11.3. We may establish general practices and limits concerning the use of the website and the services we provide, including limits to the size and number of any messages that have been sent, or the duration that any messages may be stored on our website. We are entitled to delete any material from our website at any time, and we will not be liable for deleting or not storing any material that you may transmit to us.

                                                        12. Damage to your computer

                                                          12.1. Clarks make every effort to ensure that this website is free from defects or viruses. It is your responsibility to ensure that you use the correct equipment when using the website, and to protect from anything that may damage it.

                                                            13. Links to other websites

                                                              13.1. We take no responsibility for the content or operation of third party websites that you may access following links from this website. We strongly advise that you read our Privacy Policy and terms and conditions relating to any third party websites that you visit.

                                                                13.2. We do not hold any responsibility for any third party website or its content under any circumstance.

                                                                  14. Product reviews

                                                                    14.1. You may leave a review of a product by clicking on the link on its specific product page or via our service emails. We aim to review and publish all product reviews within 4-5 working days of posting (subject to our approval guidelines).
                                                                      14.2. By providing a customer review you grant us and our third party service providers a non-exclusive royalty free license to use such content and the right to use the name you submit in connection with such review, including the processing and management thereof. We reserve the right to use customer reviews for any purpose or to disregard any customer reviews, at our sole discretion. We reserve the right to change, condense or delete any content on our website that we deem, violates our terms of use, or is contrary to the values that we hold as a company.

                                                                        14.3. By submitting your email address in connection with your rating and review, you agree that Clarks and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.

                                                                          15. Password and security

                                                                            15.1. If you use the site and have registered for an account with us, you are responsible for maintaining the confidentiality of your account and password, and also for ensuring that unauthorised access to your account is prohibited. You should take all necessary steps to ensure that your information is kept confidential to you and we would therefore recommend that you use a password unique to Clarks.                                                                               15.2. Clarks will not be responsible for any unauthorised access to your account and for any resultant damage or loss suffered by you, under any circumstance.
